Post Decree Problems
John Heilbrun has 30 years experience helping clients with family, marital and domestic law problems including divorce, dissolution, property division, alimony/spousal support, parenting/child custody issues, visitation issues, child support and post-decree matters.
Unfortunately, even after a Decree of Divorce or Dissolution is entered by the Court and the marriage terminated, there are several potential issues which may arise in the future between former spouses. These issues may include modification of the original allocation of parental rights and responsibilities, including modification of a Shared Parenting Plan, changes of custody or modification of child support. In addition, in cases where spousal support has been ordered, there may be circumstances where the initial Order may be subject to being modified or terminated earlier than provided in the original Order.
Additionally, Post-Decree proceedings may be necessary where one party fails to comply with his or her obligations under the terms of a Court Order, and it is therefore necessary to invoke the continuing jurisdiction of the Court to require that party to comply with the obligations in question. These are usually referred to as "Contempt" proceedings.
