Spousal support (formerly known as "alimony") is the obligation of one spouse to provide monetary support for the benefit of the other spouse following the termination of the marriage. Spousal support is not ordered in every case of Divorce or Dissolution, and there is no set formula that can be applied to determine whether spousal support will be paid in a particular case, and if so, how much, for how long and by which spouse. Ohio law sets forth various factors that are to be considered in determining whether spousal support is appropriate in a particular case, and if so, the amount of the spousal support and the duration for which spousal support should be paid. Specific factors referenced in the statute include the respective incomes of the parties, each spouses relative earning capacity, the ages and physical, mental and emotional condition of each spouse, the duration of the marriage, the standard of living that the parties established during the marriage, the assets and liabilities of each party, the tax consequences of a spousal support order and whether a spouse has lost income production capacity as a result of that spouse's efforts in raising the parties' children and/or taking care of other marital responsibilities.
