Legal Separation in Ohio

In Ohio, married couples who wish to separate but do not wish to terminate their marriages for religious or other personal reasons may seek a legal separation.

Some married couples eventually desire to live separately but without legally ending their marriages.  This may be due to religious beliefs, practical reasons such as healthcare benefits, or because of a variety of personal reasons. Like divorce, legal separation requires the filing of a formal action with the Court that details the grounds on which the separation should be granted; in a legal separation, however, the marriage will remain legally intact at the conclusion of the proceedings.

The filing of a legal separation action is not required to live apart from your spouse in Ohio.  However, if you and your spouse are considering separating for a long period of time, or potentially forever, but for whatever reasons, the two of you do not wish to legally and finally terminate your marriage, the filing of a formal legal separation action may be the best way to proceed.  In a legal separation action, the Court will address many of the same issues that arise in dissolution or divorce proceedings including:

  • Division of property and other assets
  • The allocation of parental rights and responsibilities involving minor children including issues related to custody and support
  • Spousal support/alimony
