Mediation
Spouses who have decided to end their marriage have a number of options from which to choose in deciding how this will be achieved. One available option for spouses who wish to resolve all of the issues incident to the ending of the marriage by agreement, is Mediation.
When first meeting with his clients, Attorney John Heilbrun will discuss the various options that exist for the client and her/his spouse to reach agreement on all issues that arise when a marriage is ending, including the Mediation Process.
If the spouses decide to use the Mediation Process, they will jointly retain the services of an objective, third party, who is trained in the art of Mediation. The Mediator’s role is to assist the spouses in coming to an agreement on all issues. Although the Mediator is likely to be an attorney with substantial knowledge and experience in cases involving the ending of a marriage, in the Mediation Process, the Mediator will not be the attorney for either spouse. Accordingly, in most cases, clients who choose to pursue Mediation in an effort to reach agreement on all issues, will also need to each retain an attorney who will represent that spouse and provide her/him with advice and counsel throughout the Mediation Process. In some cases, the attorneys become actively involved in the Mediation Process, whereas in others, the attorneys remain “in the background” discussing the various issues and advising their clients thereon outside of the Mediation sessions with the Mediator.
If the Mediation Process is successful, at the end of the Process the Mediator will prepare a summary of the various agreements that the spouses have entered into through the Mediation Process. It will then be up to the attorneys for one, or both, spouses, to prepare the formal written Agreements that will ultimately be signed by the parties and adopted by the Court when issuing an Order formally terminating the marriage.
Mediation is another process which allows the parties to maintain complete control over all decisions that need to be made based upon the fact that their marriage is ending. Mediation is another process that will usually decrease the level of frustration, emotional tumult and stress resulting from the ending of a marriage.
