Determining Child Support
Child support payments can be determined one of two ways: Outside of the court, with you and the other parent working cooperatively to agree on the amount of support; or, in Court by a Judge determining the amount of the support obligation primarily by application of the Ohio Child Support Guidelines.
The Child Support Guidelines provide a formula that determines the amount of support based on factors including:
- Income (or imputed income) of each parent
- The number of minor children
- Health insurance expenses for the child
- Work related day care expenses
Using these guidelines, a judge determines the amount of support to be paid by one of the parents, usually the noncustodial parent.
Sometimes, certain elements may increase or decrease the support payment calculated using the guidelines. There may be unaccounted-for expenses that do not fall into any of the categories within the Ohio guidelines. Special needs of your child, the amount of time your child spends in each home and what is in the best interest of your child are all be factors that may affect the amount of child support.
