Determining Alimony

Alimony, now called spousal support in Ohio, is sometimes awarded to one spouse during a divorce in order to help cover living expenses such as food, medical care, clothing, and mortgages when there is a significant disparity in the wealth and earning capacity of each spouse at the time of the divorce. In some instances, alimony/spousal support may also be awarded in order to help both parties maintain the standard of living they enjoyed prior to the divorce.

There are several factors which will be considered by the court when determining alimony/spousal support, including:

• Number of years the couple was married
• Standard of living established during the marriage
• Education level, income, and earning capacity of each spouse
• Age and health of each spouse
• Work limitations experienced by one spouse based on child custody or parenting agreements
• Ability of the receiving spouse to reenter the workforce or obtain additional education that will improve earning capacity

Depending on the circumstances of your divorce, the court may award alimony/spousal support for a fixed period of time, or it may be awarded indefinitely.
