Will My Spouse have to Pay Some or All of My Attorney Fees?
In the state of Ohio, the court has the authority to order one spouse to pay some or all of the other spouse’s legal fees during a divorce. This typically happens when the financial status and income of each spouse are significantly different.
When determining what percentage of legal fees will be paid by the other spouse, the court will evaluate all the relevant factors including the following:
- Income of each spouse
- Conduct of each spouse in the divorce process and whether either spouse may have been unreasonable thereby unnecessarily increasing the attorney fees of the other
- Each spouse’s separate assets
- Any award of temporary spousal support
- The ability of one spouse to pay the attorney fees of the other
